These Terms of Service are a legally binding agreement between you and ChronicGPT Inc., governing your access to and use of our websites, mobile applications, and related services available at https://www.chronicgpt.com (collectively, the "Services").

  • ChronicGPT is a health and wellness technology service. Unless we clearly state that a licensed clinician is providing a specific clinical service to you, ChronicGPT does not replace your doctor, does not provide emergency care, and does not create a physician-patient relationship.
  • AI outputs may be incomplete, inaccurate, or inappropriate for your situation. You should verify important health decisions with a licensed healthcare professional.
  • Do not use ChronicGPT for emergencies. If you may have a medical emergency, call 911 in the United States, 112 or 108 in India, or your local emergency number.
  • You must be at least 18 years old to use ChronicGPT.
  • You are responsible for the accuracy of information you provide, including symptoms, medications, labs, wearable data, food logs, and health history.
  • Connecting Apple Health/HealthKit is optional. The app explains the requested data categories before asking for Apple Health permissions, and you can revoke access in Apple Health or iOS Settings.
  • Some features may require a paid subscription, in-app purchase, wearable rental, lab/CGM integration, or third-party service.
  • You must use the app lawfully and may not misuse, reverse engineer, scrape, overload, or attempt to extract models, prompts, algorithms, or datasets.
  • Your privacy is governed by our Privacy Policy. These Terms and the Privacy Policy work together.
  • Apple is not responsible for ChronicGPT; ChronicGPT Inc. is responsible for support, claims, and compliance for the iOS app.

1. Agreement to These Terms

These Terms of Service (the "Terms") are a legally binding agreement between you and ChronicGPT Inc., doing business as ChronicGPT ("ChronicGPT," "we," "us," or "our"). These Terms govern your access to and use of our websites, mobile applications, iOS app, software, chat interfaces, AI tools, care-support workflows, wearable and nutrition features, subscriptions, communications, and related products and services (collectively, the "Services"). By creating an account, downloading the app, accessing the Services, tapping "I agree," purchasing a subscription, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of another person, organization, employer, healthcare provider, clinic, or care team, you represent that you have authority to do so and that you will ensure that the person or organization understands and agrees to these Terms.

2. Who May Use the Services

Age requirement: You must be at least 18 years old to use the Services. The Services are not intended for children or teenagers. Territory: ChronicGPT is currently intended for users located in the United States and India. You may not use the Services if doing so would violate applicable laws where you are located. Account standing: We may deny, suspend, or terminate access if you violate these Terms, fail to pay required fees, provide false information, misuse the Services, create safety risk, or use the Services in a way that may harm users, clinicians, partners, or our systems.

3. What ChronicGPT Provides

ChronicGPT may provide some or all of the following features, depending on availability, subscription status, geography, regulatory approvals, and product stage:

  • AI-guided health conversations, symptom intake, health education, and condition-specific coaching.
  • Meal, nutrition, calorie, macronutrient, glucose, blood pressure, medication, sleep, activity, and wearable-data logging.
  • Personalized wellness plans for goals such as weight management, diabetes support, hypertension support, sleep support, and healthy behavior change.
  • Insights based on data you provide or connect, including Apple Health, HealthKit, CGM, SMBG, wearable, lab, medication, food, and activity data.
  • Reminders, nudges, app notifications, SMS, WhatsApp, email, or other communications if available and enabled.
  • Optional human review, care-team coordination, telehealth referrals, prescription-related workflows, or clinician services if separately offered in your jurisdiction.
  • Store, rental, rewards, grocery, wearable, and program-related features if offered.

Availability: We may add, modify, suspend, discontinue, or limit Services at any time, including for safety, compliance, product-development, payment, fraud-prevention, or operational reasons.

4. Medical, AI, and Safety Disclaimers

4.1 Not Emergency Care

The Services are not for emergencies. If you think you may have a medical emergency, call 911 in the United States, 112 or 108 in India, or your local emergency number immediately. Do not wait for a response from ChronicGPT.

4.2 AI Is Not Perfect

AI-generated outputs can be incomplete, inaccurate, outdated, biased, unsafe, or inappropriate for your circumstances. You should not rely solely on AI-generated content to make important medical, medication, diagnostic, treatment, nutrition, exercise, or safety decisions.

4.3 No Physician-Patient Relationship Unless Clearly Stated

Except where a licensed clinician explicitly provides a clinical service to you through a separate clinical workflow, the Services do not create a physician-patient, clinician-patient, therapist-patient, dietitian-patient, or pharmacist-patient relationship. General AI, coaching, educational, symptom-checking, and wellness features are not a substitute for professional medical advice, diagnosis, treatment, or emergency care.

4.4 Human Clinician Services

If ChronicGPT offers access to licensed clinicians, telehealth visits, prescription-renewal review, lab review, or similar clinical services, those services may be provided by independent professional entities, licensed clinicians, pharmacies, labs, or other partners. Additional consent forms, clinical intake requirements, identity verification, payment terms, state-specific or India-specific notices, and professional terms may apply. A clinician may decline to provide treatment or prescriptions if, in their professional judgment, it is not appropriate or lawful.

4.5 Do Not Ignore Professional Advice

Never disregard, avoid, or delay professional medical advice because of something you read, hear, or receive from ChronicGPT. Continue following your clinician treatment plan unless your clinician changes it.

4.6 Medication, Labs, CGM, and Wearable Data

Medication, lab, CGM, blood glucose, blood pressure, ECG, sleep, activity, and wearable data may be delayed, incomplete, inaccurate, device-dependent, user-entered, or affected by sensor error. You are responsible for using FDA-cleared, authorized, physician-recommended, or otherwise appropriate devices where required and for verifying results with your healthcare professional.

5. Regulated Medical Device and Clinical-Decision Boundaries

Unless we expressly state otherwise for a specific feature, ChronicGPT is intended to support health education, wellness, self-management, care preparation, and behavior change. It is not intended to independently diagnose, prevent, treat, cure, or mitigate disease, replace clinician judgment, or control life-sustaining or high-risk medical decisions. If a feature is regulated as a medical device, clinical decision support tool, prescription workflow, or telehealth service in a jurisdiction, we will make that feature available only as permitted by applicable law and may require additional notices, consents, clinician oversight, identity verification, regulatory information, or geographic restrictions.

6. Your Account and Responsibilities

  • You must provide accurate, current, and complete information, including age, sex, health history, medications, allergies, symptoms, wearable data, and payment information when requested.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must promptly update your profile and medical information when it changes.
  • You must not share your account, impersonate another person, create accounts for deceptive purposes, or use another person data without permission.
  • You must notify us promptly at support@chronicgpt.com if you suspect unauthorized access or account compromise.

7. User Content and Health Information You Submit

You may submit text, voice, images, lab reports, medication lists, food logs, symptoms, wearable data, CGM data, Apple Health data, blood glucose readings, blood pressure readings, notes, and other information ("User Content"). You retain ownership of your User Content, subject to the rights you grant us below. License to operate the Services: You grant us a non-exclusive, worldwide, royalty-free license to host, process, analyze, display, transmit, transform, summarize, store, and use your User Content as necessary to provide, maintain, secure, improve, troubleshoot, and support the Services; comply with law; enforce these Terms; and fulfill consented or authorized product functions. Our use of personal information and health information is governed by our Privacy Policy. Accuracy: You understand that the quality of AI outputs and recommendations depends on the accuracy and completeness of the information you provide. You should not submit false, misleading, incomplete, unlawful, or third-party information without proper authorization.

8. Acceptable Use

You agree not to:

  • Use the Services for emergencies, self-harm instructions, illegal activity, fraud, harassment, abuse, or exploitation.
  • Use the Services to obtain prescriptions, medical documents, benefits, insurance claims, or workplace accommodations through false or misleading information.
  • Reverse engineer, decompile, disassemble, scrape, crawl, data mine, benchmark at scale, extract prompts, extract model behavior, or attempt to derive source code, models, weights, datasets, or system instructions.
  • Interfere with, overload, disrupt, bypass, or compromise the Services, security controls, access controls, rate limits, authentication, or monitoring systems.
  • Upload malware, harmful code, corrupted files, or content that infringes, violates privacy, or violates law.
  • Use the Services to build a competing product, train third-party models, or perform automated bulk extraction without our written permission.
  • Misrepresent AI output as a licensed clinician decision when it is not.

9. Subscriptions, Purchases, Billing, and Renewals

Some Services may require payment, a subscription, an in-app purchase, a program fee, a rental fee, or third-party purchase. Pricing, renewal period, included features, auto-renewal details, cancellation details, and links to applicable terms will be disclosed at the time of purchase. Auto-renewal: If you purchase an auto-renewing subscription, it will renew automatically unless canceled before the renewal deadline shown in the purchase flow or app-store settings. For Apple in-app purchases, billing, renewal, and cancellation are handled by Apple through your Apple ID and App Store account settings. No prorated refunds unless required: Unless required by law or stated in a specific offer, cancellation stops future renewal but does not automatically produce a prorated refund for the then-current period. Price changes: We may change pricing or plan features prospectively. We will provide notice where required by law or platform rules. Payment processors: Payments may be processed by Apple, Stripe, Razorpay, banks, card networks, UPI providers, or other payment partners. We do not control third-party payment systems and are not responsible for their independent acts or omissions. Taxes: You are responsible for applicable taxes unless we state that taxes are included.

10. Programs, Rewards, Cash Back, and Promotions

ChronicGPT may offer programs, challenges, discounts, cash back, points, rewards, or outcome-based promotions. Each promotion may have separate eligibility rules, start and end dates, verification criteria, exclusions, anti-fraud rules, and payout methods.

  • Rewards are not guaranteed unless all program conditions are satisfied and verified by us.
  • We may deny, reverse, or withhold rewards for suspected fraud, inaccurate data, device manipulation, duplicate accounts, chargebacks, abuse, noncompliance, or safety concerns.
  • Health outcomes vary. We do not guarantee weight loss, A1C improvement, glucose control, blood pressure improvement, medication changes, or any specific clinical result.
  • Promotions are void where prohibited and may be modified or discontinued as permitted by law.

11. Store, Grocery, Wearable Rental, and Third-Party Products

If ChronicGPT offers grocery packs, protein packs, wellness products, wearable rentals, CGM-related workflows, partner products, or delivery coordination, additional product terms may apply.

  • Food, grocery, supplement, medication, device, and wearable availability may vary by location and partner.
  • You are responsible for reviewing ingredients, allergens, nutrition labels, expiration dates, device instructions, manufacturer warnings, and clinician guidance.
  • Wearable and device data is for reference and may not be accurate enough for diagnosis or treatment unless the device and feature are authorized for that use.
  • Rental devices must be returned in the condition and timing required by the rental terms. Loss, damage, late return, or failure to return may result in charges.
  • Third-party products and services are provided by their respective manufacturers, sellers, labs, pharmacies, delivery providers, or platforms. Their terms and warranties may apply.

12. Communications, SMS, WhatsApp, Email, and Push Notifications

By providing your phone number, email address, WhatsApp number, or enabling app notifications, you agree that we may send you service-related messages, account alerts, security notices, reminders, program messages, treatment-related communications where authorized, and other communications related to your use of the Services. SMS/WhatsApp and carrier charges: Message and data rates may apply. You may opt out of promotional SMS by replying STOP where supported. Opting out of certain service or treatment-related communications may limit the Services. Not fully secure: SMS, email, WhatsApp, and push notifications may not be fully secure or encrypted end-to-end in all circumstances. Do not use these channels for emergencies.

13. Apple Health, HealthKit, and Other Connected Data Sources

If you choose to connect Apple Health, HealthKit, CGM platforms, wearable platforms, labs, pharmacies, or other data sources, you authorize us to access and process the categories of data you permit for the purposes described in the app and Privacy Policy. Connecting Apple Health is optional. ChronicGPT will request HealthKit permissions only after explaining the purpose of the requested data in the app. You can manage or revoke Apple Health permissions at any time in Apple Health or iOS Settings.

  • You can manage Apple Health permissions in iOS Settings and the Health app.
  • HealthKit data will not be used for advertising, targeted advertising, marketing attribution, data-broker purposes, unrelated product development, or public foundation-model training.
  • We will not write false or intentionally misleading data to HealthKit.
  • You may request deletion of Apple Health data previously imported into ChronicGPT, subject to legal, safety, audit, dispute, healthcare, clinical, and regulatory retention requirements.
  • Third-party device and platform terms apply to your use of those services.

14. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, protect, and delete personal information and health information. The Privacy Policy is incorporated into these Terms. If there is a conflict between these Terms and the Privacy Policy regarding privacy practices, the Privacy Policy controls for privacy matters.

15. Intellectual Property

The Services, software, interfaces, designs, text, graphics, logos, trademarks, service marks, algorithms, models, workflows, prompts, documentation, and other content are owned by ChronicGPT Inc., ChronicGPT, or our licensors and are protected by intellectual property and other laws. Limited license: Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your own personal, non-commercial health and wellness use, or for another person only with proper authorization and consent. Feedback: If you provide ideas, suggestions, bug reports, or feedback, you grant us the right to use them without restriction or compensation, unless prohibited by law or agreed in writing.

16. Third-Party Services and Links

The Services may integrate with or link to third-party services such as Apple, Stripe, payment processors, Twilio, WhatsApp, wearable platforms, CGM platforms, labs, pharmacies, identity verification providers, cloud providers, analytics providers, app stores, clinicians, or care partners. We are not responsible for third-party services, data, content, availability, security, acts, omissions, or terms. Your use of third-party services is subject to their terms and privacy policies.

17. Beta, Pilot, and Experimental Features

We may offer beta, pilot, early-access, research, or experimental features. These features may be incomplete, inaccurate, interrupted, changed, or discontinued. Unless otherwise stated, beta and pilot features are provided for evaluation and are not guaranteed to produce clinical, wellness, financial, or operational outcomes.

18. Service Availability and Support

We strive to maintain reliable Services but do not guarantee uninterrupted, secure, or error-free operation. The Services may be unavailable due to maintenance, outages, security events, third-party failures, network issues, app-store issues, force majeure events, or other reasons. 19. Termination

You may stop using the Services at any time. You may delete your account or request deletion as described in the Privacy Policy and in-app account controls where available. We may suspend or terminate your access if you violate these Terms, create risk, fail to pay, misuse the Services, provide false information, violate law, or if continued access would create safety, compliance, clinical, platform, or operational concerns. Termination does not relieve you of payment obligations incurred before termination or obligations that by their nature should survive.

20. Disclaimers of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, merchantability, security, uninterrupted operation, or clinical outcome. We do not warrant that AI outputs, health insights, calorie estimates, nutrition data, glucose estimates, wearable data, reminders, or recommendations will be correct, complete, timely, safe, suitable, or effective for you.

21. Limitation of Liability

To the maximum extent permitted by law, ChronicGPT Inc., ChronicGPT, and our officers, directors, employees, contractors, licensors, partners, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, lost profits, lost data, loss of goodwill, personal injury caused by misuse or reliance contrary to these Terms, business interruption, or substitute services, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to us for the Services during the three months before the event giving rise to the claim, or (b) USD $100 or INR equivalent, as applicable. Some jurisdictions do not allow certain limits, so some limitations may not apply to you.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ChronicGPT Inc., ChronicGPT, and our officers, directors, employees, contractors, licensors, partners, and service providers from and against claims, liabilities, damages, losses, costs, and expenses arising from or related to your User Content, misuse of the Services, violation of these Terms, violation of law, violation of third-party rights, fraud, or use of the Services on behalf of another person without proper authority.

23. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms and update the "Last updated" date. If changes are material, we will provide notice through the app, website, email, or other reasonable method where required. Your continued use after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Services.

24. Governing Law and Dispute Resolution

United States users: These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules, except where federal law or mandatory consumer-protection law provides otherwise. Subject to the informal resolution process below, any dispute will be handled in the state or federal courts located in Texas unless mandatory law requires another venue. India users: For users located in India, India-specific consumer-protection, data-protection, telemedicine, medical practice, and other mandatory local laws apply where required. Subject to those mandatory rights, ChronicGPT Inc. may maintain contractual rights under Texas law to the extent permitted. India-specific grievances may be submitted to grievance@chronicgpt.com. Informal resolution: Before filing a claim, you agree to contact us at legal@chronicgpt.com with a description of the dispute and requested resolution. We will attempt to resolve the dispute informally within 30 days, unless urgent legal relief is required or mandatory law provides otherwise. Nothing in this section limits rights that cannot be waived under applicable consumer, privacy, healthcare, or platform law.

25. Apple / iOS App Terms

This section applies when you download or use the ChronicGPT app on an Apple-branded device.

  • These Terms are between you and ChronicGPT Inc., not Apple. Apple is not responsible for the app or its content.
  • We grant you a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by Apple Media Services Terms and applicable Usage Rules.
  • ChronicGPT Inc., not Apple, is responsible for maintenance and support for the app, as specified in these Terms or required by law.
  • If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • ChronicGPT Inc., not Apple, is responsible for addressing claims relating to the app, including product liability claims, legal or regulatory claims, consumer-protection claims, privacy claims, and claims involving HealthKit or similar frameworks.
  • ChronicGPT Inc., not Apple, is responsible for investigating, defending, settling, and discharging any third-party intellectual-property claim that the app or your use of it infringes third-party rights.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not on any U.S. government prohibited or restricted party list.
  • You must comply with applicable third-party terms when using the app, including Apple, wireless carrier, payment, wearable, CGM, lab, pharmacy, and communication-platform terms.
  • Apple and Apple subsidiaries are third-party beneficiaries of this section and may enforce it against you.

26. United States Addendum

  • Emergency: Call 911 for emergencies.
  • HIPAA: ChronicGPT may not always be a HIPAA covered entity or business associate. When HIPAA applies to a specific clinical, covered-entity, or business-associate workflow, we will handle protected health information as required by HIPAA and applicable agreements. Our Privacy Policy explains our privacy practices.
  • Telehealth: If telehealth or clinician services are offered, availability may depend on your state, clinician licensure, standard of care, identity verification, consent, and professional judgment.
  • Prescriptions: AI does not independently prescribe medication. Prescription-related services, if offered, require legally authorized clinician review and approval unless applicable law changes and counsel approves an alternative workflow.
  • Health breach notice: If applicable law requires notification of a breach of identifiable health information, we will provide notice as required by law.
  • FDA/regulatory status: Unless clearly stated otherwise for a specific feature, the Services are not intended to be a regulated medical device and are not intended to independently diagnose, treat, cure, mitigate, or prevent disease.

27. India Addendum

  • Emergency: Call 112, 108, or your local emergency number for emergencies.
  • Medical advice: AI and wellness guidance are not a substitute for consultation with a registered medical practitioner.

Where clinical services are offered, they must comply with applicable India telemedicine, medical practice, pharmacy, prescription, and consumer-protection laws.

  • Data protection: Our collection and processing of personal data is governed by our Privacy Policy and applicable India data-protection law, including consent, notice, grievance, correction, erasure, and withdrawal rights where applicable.
  • Language: We may provide notices or support in English and selected Indian languages where available. Machine translation may be imperfect and should be verified for important clinical or legal matters.
  • Grievance contact: India-specific grievances may be submitted to grievance@chronicgpt.com.
  • Consumer protection: Nothing in these Terms limits rights that cannot be waived under applicable India consumer-protection law.

28. Miscellaneous

  • Entire agreement: These Terms, Privacy Policy, and any feature-specific terms are the entire agreement regarding the Services.
  • Severability: If a provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
  • Survival: Sections concerning safety disclaimers, payment obligations, intellectual property, privacy-related obligations, limitation of liability, indemnification, dispute resolution, and other provisions that by their nature should survive will survive termination.
